Prior to completing this form, please review what types of requests cannot be reported below.
The building team is only able to investigate matters which directly relate to the Building Act 1993. All concerns must be in writing for the building team to carry out an investigation.
Please be assured that any notifications will remain anonymous and details are not provided to the property owners.
What can and cannot be reported
Building Services can only investigate matters as authorised under the Building Act (1993). This includes matters such as
- Construction works commencing without a building permit in place
- Use of a building commencing without a building permit in place
- Buildings or construction work posing a danger to life, safety or health
- Unmaintained or missing safety or emergency equipment, installations or services
We can only investigate building related matters which are in writing unless they are an emergency.
Current construction
The Building Act 1993 established a privatised system of ensuring compliance with the relevant legislation and codes. If construction is currently underway review the signage that must be at the property and contact the listed Private Building Surveyor. If the Private Building Surveyor is unable to assist then you should contact the Building & Plumbing Commission.
Fences and retaining walls
These fall under the jurisdiction of the Fences Act 1968 and is best if neighbours can resolve the matter between themselves. Council can only investigate matters which relate directly to impacts on safety of the public (such as front or side fences being too high or in poor condition).
Stormwater
The flow of surface stormwater is not regulated under Building Legislation - Council can only investigate stormwater issues that relate to an alteration or disconnection of a stormwater system associated with the building (such as the removal of guttering disconnection of downpipes etc).
Plants Overgrowing onto my property
Plants overgrowing into your property is a civil matter. We recommend that you try to resolve this directly with your neighbour.
