Food Allergen deaths and incidents in Victoria
Our Environmental Health Officers will discuss allergens with Food businesses during their food safety compliance assessment.
The following examples of allergen reactions with the most severe causing death, demonstrate why we discuss your allergen processes, even if you don’t serve allergen free food. These are all related to businesses in Victoria.
Deaths
An inquest investigated the death of 17-year-old who died from anaphylaxis after eating a burrito bowl he ordered online in 2021. He was unaware it contained cashews because of a lack of information on the delivery app.

64-year-old was allergic to dairy, but the upmarket restaurant in Melbourne had always been a ‘safe’ option, until her death in 2014 kitchen and wait staff had a communication glitch causing death.

Food allergen fines
- 2022 customer requested food that did not contain shellfish and who had alerted the wait staff to his seafood allergy. The staff member had not received adequate allergen training and served the incorrect dumpling to the customer. Restaurant cops hefty fine for serving dumplings, causing an anaphylactic reaction.
- 2020 unregistered food business sold a grazing platter which contained a Kinder Bueno Bar to a customer who requested the platter not to contain nuts but only traces of nuts. Chocolate Bar sold by an unregistered food business causes Anaphylactic Reaction.
- 2013 Melbourne magistrates court ordered a catering company to pay $55,000 after a waiter served an 8 year old, a frozen dessert and ''guaranteed'' it was dairy-free. It was vanilla ice-cream! Catering Company fined $55,000 after near death allergic reaction to ice-cream.
