Food Business Compliance
We always aim to educate and help businesses comply with the Food Act 1984 and the Food Standards Code.
Our education and assistance involve onsite learnings and discussions during our inspections.
This also includes topics covered in our newsletters, such as:
- having adequate hand washing facilities,
- having uncovered foods on display,
- staff members not handling foods safely,
- coming to work with gastro symptoms/food poisoning,
- changes to requirements in legislation or codes, or
- not paying a Food Act renewal on time.
However, where this education hasn’t worked to address a problem, or there is a risk to public health, enforcement action can be taken by Council.
Enforcement action can range from warnings and Food Act Orders through to fines and even court prosecution.
Common Questions
All Out of School Hours Care (OSHC) programs that prepare and serve food as part of the service will be required to register under the Food Act.
Last year during routine inspections of school canteens our officers noticed that several schools used an external provider for their OSHC programs.
These operators need to register separately from the school’s registration, this will ensure they are compliant under the Food Act 1984, and have routine inspections conducted whilst operating.
