Consent to build on land liable to flooding

Council Consent is required to construct a building on land that is designated liable to flooding.

Proposed buildings within flood prone areas must be assessed for safety, ensuring the proposed structures do not obstruct natural drainage or water flow and create risk for you or any future occupants.

Regulation 51.2 building information certificates include if your land is within a flood prone area or not.

Your certificate will also include if your land is subject to termites, within a fire prone area or subject to any developer contribution levies.

The building surveyor you have appointed to issue your building permit will determine if Council consent is required.

It is not recommended you apply before receiving this determination, as some exemptions do apply even if your land is within a flood prone area.
