Consent to build over a drainage easement

Council Consent is required prior to commencing any building or works encroaching a Council owned easement.

Proposed building and works encroaching a Council easement must be assessed to ensure that any infrastructure or assets are not damaged and can be accessed in future should maintenance, repair or upgrade works be required.

The location of any easements and who holds the rights to them can be found on your plan of subdivision.

There are different reasons for easements being listed on your plan of subdivision. 

Generally, the responsible authority that maintains the type of asset or infrastructure is the listed beneficiary and will be your main point of contact. Some examples include:

City of Greater Geelong 
  • Drainage and stormwater
Barwon Water
  • Water and sewerage
Powercor
  • Electricity
Ausnet
  • Gas

The building surveyor you have appointed to issue your building permit will determine if Council consent is required. 

It is not recommended you apply before receiving this determination, as some exemptions may apply.

Complete and sign the relevant application form and prepare the mandatory documents for lodgement. These include;

Working drawings
  • Including a site plan, elevations and clear documentation of the proposed easement encroachment.
Title documentation
  • Including a plan of subdivision, title search and any restrictions, covenants or agreements.

Lodge your application by attaching the above documents and emailing it through to [email protected]

Once your application is received, we will issue you with an invoice. All outstanding fees must be paid prior to assessment of your application commencing.

Applications can take up to four weeks to be assessed before you receive a formal decision.

We may take longer than four weeks if:

  • Documentation provided is incomplete or further information and/or clarification is required.
  • Your application needs to be referred to a reporting authority.

To ensure your application is not delayed, it is recommended you check that your working drawings include the information below.

Correct easement details 
  • This can be located on your plan of subdivision
Pipe details
  • Please include the size, depth and offset 
  • You can request this information by emailing [email protected]
Please note: Council can only provide information that is available on file for some properties. Where information does not exist, you may need to undertake further investigation to determine this information.  
Scope of works
  • Details of all proposed building work encroaching into the City's easement must be detailed within your set of plans
  • Please include depths, clearances and structure encroachment measurements and details of footing system including type and dimensions
Angle of repose
  • Clear demonstration of how angle of repose to the City's stormwater asset is satisfied (no pressure on the pipe) 
  • Clearly nomination of clearances from the edge of the proposed footing to the asset
