Council Consents

Your building project must meet the Building Regulations 2018. If it doesn’t, you must get 'report and consent' for the part of your project that doesn't meet the regulations. This is sometimes called a dispensation, and it means that you have gotten the approval of the relevant authorities to continue with your project. You need this report and consent before you can get a building permit.

Consent types

  1. Council Report and Consent Non-Siting Matters
    example: projections beyond street, public protection, land liable to flooding
  2. Council Consent Siting Matters
    examples: setbacks, wall heights and lengths, site coverage
  3. Drainage Easement
    For construction over or excavation into a drainage easement
  4. Protection of the Public Council Consent

Why you need a Report and Consent

You must get a Report and Consent if your building project does not meet a requirement of the Building Regulations 2018.

Report and Consent applications generally relate to:

  • Siting (Part 5 of the Building Regulations) - the siting and positioning of domestic buildings that do not meet the standard regulations, such as reducing the minimum frontage setback, exceeding maximum building heights or
  • Projections beyond street alignment Part 6 of the Building Regulations, and building works that are above or below certain public facilities (Regulation 134) or
  • Building in areas liable to flooding or construction on designated land or designated works (Regulations 153 and 154): or
  • Building over or near an easement (Regulation 130) or
  • Installing precaution to protect the public over the street alignment (Regulation 116) or
  • Demolition of a building (Section 29a of the Building Act).

If you have engaged a Building Surveyor they will be able to assist you with the application or apply on your behalf.

Where you have already received consent for your design but now need to vary it, you must apply to council for this change. To do this select the appropriate document below - amendment.  

  1. Complete the application form including all supporting documentation
  2. Submit this to [email protected]

You will be invoiced for the relevant fee. 

Please ensure that you respond in a timely manner to all requests for further information so as to not delay your application.

If you need more time to commence your construction than what is indicated on your approved consent you will need to request an extension of time. To do this select the appropriate document below - extension of time.  

  1. Complete the application form including all supporting documentation
  2. Submit this to [email protected]

You will be invoiced for the relevant fee. 

Please ensure that you respond in a timely manner to all requests for further information so as to not delay your application.

NOTE - you cannot request an extension of time for an already expired Report and Consent - this will require you to complete the whole application process again.

Applications can take up to two weeks to process. You will be formally advised of our decision on your application.

Note the process may take longer than two weeks if:

  • the information lodged is incomplete
  • more information or clarification is required
  • the application needs to be sent to a referral authority for assessment
  • submissions are sought from adjoining owners.
