Building on land liable to flooding

Report and Consent is required to construct a building on land that is liable to flooding or construction on designated land or designated works. 

If you are unsure if your land is prone to flooding you may obtain a Property Information Certificate from Council which will provide you these details. 

We will make an assessment based on the location of the building flood studies relevant data and provide a minimum finished floor level.

Projects beyond street alignment or building above or below certain public facilities

This can include a street railway or bus terminal.

Report and Consent of Council is required for items such as:

  • architectural features
  • service pipes and rainwater heads
  • signs
  • sunblinds and awnings
  • verandahs
  • windows and balconies and window shutters which project beyond the street alignment. 

This is to ensure that the proposed projection will not be detrimental to the safety of the public.

Application Process

Complete the correct Report and Consent application form for non-siting matters. On page 2 remember to select the relevant regulation / reporting matters:

  • Part 6 Regulation 109: Projections beyond street alignment
  • Part 8 Division 2 Regulation 134: Building above or below certain public facilities
  • Part 10 Regulation 153: Building on Land Liable to Flooding
  • Part 10 Regulation 154: Build on designated land

Include all the required attachments:

  • Have your certificate of title plan of subdivision and any other relevant title documents.  These can be obtained from Landata.
  • Have the proposed working drawings completed

Lodge your application by attaching the above documents and emailing it through to [email protected]

You will receive an invoice for payment this must be paid prior to any work commencing on your application.

Applications can take up to four weeks to process.  You will be formally advised of Councils decision on your application.

We may take longer than four weeks if the:

  • information lodged is incomplete and/or more information or clarification is required
  • application needs to be referred to a reporting authority.
