Public protection and street occupation permits

When works require precautionary measures to be installed on City land, you will require a report and consent and/or a Street/Footpath Occupation Permit.

Public Protection measures over the street alignment

Precautions must be taken out before and during building work (authorised under a building permit) in order to protect the safety of the public as prescribed in the Building Regulations 2018 Regulation 116 Protection of the Public.

You will need to apply for a Report and Consent if the proposed protection measures are required to be installed over the street alignment.

If the protection measures are 'approved' you will then need to apply for a Street Occupation permit - works cannot commence until you have both of these permits.

Application process

  • Complete the Regulation 116 Report and Consent Application
  • Have your certificate of title plan of subdivision and any other relevant title documents. These can be obtained from Landata.
  • Written approval and endorsed plans from a building surveyor
  • Written statement indicating scope of works
  • Scaled drawings of the proposed works
  • Traffic Management Plan and other required papers
  • Lodge your application by attaching the above documents and emailing it through to [email protected]
  • You will receive an invoice for payment this must be paid prior to any work commencing on your application.
Do I need a Protection of the Public Report and Consent

If the works you are carrying out have an appointed Building Surveyor - they will determine when protection measures are required to protect the safety of the public.

Street/footpath Occupation Permits

We require a Street/footpath Occupation Permit to be issued prior to the occupation of our assets (footpath laneway road etc).

If using City Land - which can include roads, footpaths, laneways, verge or similar to place any of the following type items:

  • placing plant and equipment such as scissor lifts excavators or concrete pumps
  • using cranes including support equipment vehicles and franner cranes
  • erecting hoarding temporary fencing gantry scaffolding or site shed
  • creation of a construction zone
  • small works areas such as using ladders and mobile scaffolding
  • creation of a work zone which is used during a specific period of time.

Application processing time

Applications can take up to two weeks to process. You will be formally advised of our decision on your application.

We may take longer than two weeks if the information lodged is incomplete and/or more information or clarification is required.

If you have an approved Protection of the Public (Reg 116) consent you will then need to apply for a Street Occupation permit - works cannot commence until you have both of these approvals if using City land.
