Permission to build over a drainage easement

Report and Consent is required from Council if you are proposing to build over an easement vested to Council.

Easements:

  • are shown on your property title and referenced plan of subdivision
  • can be located anywhere on your property
  • allow someone to use your land for a specific purpose for example sewer mains electricity supply or stormwater drainage.

Site plans are to include the 

  • Correct easement details - this can be located on the Plan of Subdivision
  • Pipe details (if applicable) including size depth and offset - you can request this information via [email protected].  Note the City is only able to provide information that they have on file for some properties where information does not exist the applicant will need to undertake investigations themselves to find out this information.  
  • Details of all proposed building work encroaching into the City's easement to be nominated on plans.  Please include depths clearances and structure encroachment measurements and details of footing system including type and dimensions
  • Please ensure structural drawings submitted clearly demonstrate how angle of repose to the City's stormwater asset is satisfied (no pressure on the pipe) and clearly nominate clearances from the edge of the proposed footing to the asset

Complete the correct application form

Include all the required attachments:

  • Have your certificate of title plan of subdivision and any other relevant title documents.  These can be obtained from Landata.
  • Have the proposed working drawings completed

Lodge your application by attaching the above documents and emailing it through to [email protected]

You will receive an invoice for payment this must be paid prior to any work commencing on your application.

Applications can take up to four weeks to process.  You will be formally advised of Councils decision on your application.

We may take longer than four weeks if the:

  • information lodged is incomplete and/or more information or clarification is required
  • application needs to be referred to a reporting authority.
